California Court Trumps Gay Marriage

An appeals court in California ruled that seperate laws for different people is in fact constitutional. The court upheld California’s ban on gay marriage, reversing a San Fransisco trial judges March 2005 ruling.

This is a big setback to the gay community and the San Fransisco treasury which will see a significant cut in revenue from marriage licenses. But their fight is not over as they plan to take their case to California’s Supreme Court.

The appeals court argued that the laws of California were not unconstitutional and do not discriminate against gays. The state has set laws for domestic partnerships which give gay couples many of the same rights as married straight couples.

So this is a pretty black and white issue here, the court says gays are ’seperate but equal.’

    Good for my state of California, and that is surprising, but encouraging. I heard about this a while back but had forgotten about it. Glad to hear some in California value the institution of marriage, one man/one woman.

    Yeah and if your girlfriends husband dies in Iraq you should take a look in the mirror and realize that you Betty are responsible too because you voted to re-elect Bush and his obvious corrupt incompetence.

    We can’t have what some call “common sense folk” be president, we need SMART (less corrupt) people as president.

    I knew from day 1 Iraq was a sham because I knew from day 1 George Bush was a sham Betty. I marked the day we “elected” that moron as the beginning of the downfall of America. I’ve predicted a lot of things correctly but one mistake I made was thinking no way the American people would be stupid enough to re-elect Bush.

    The founding fathers set up our gov’t in a way to balance stability with less corruption/tyranny. It’s set up so that only a society of fools can ruin it.

    Good morning Alex, I must defend George Bush, as a supporter. I agree with his policies and I agree we went into Iraq for a noble purpose, and, I am not alone in that. I volunteer at the VA Hospital and most all the Vets (young and old) agree that Bush is a great leader, he stands by his convictions.

    My wife is a statistician at a university and has worked with the VA and knows how many soldiers are coming back with mental disorders and how many won’t receive the proper treatment they need.

    But hey ExxonMobil made a record $40 billion last year. Woohoo!!

    Hi Alex, I am not going try and justify what I have heard, what I believe and how I feel about our nation and our troops.

    I will say I do know (about the “gay marriage” issue that it is wrong) it is not a natural thing for members of the same sex to “marry”…to distort the institution of Marriage. That is how I and MANY others feel. And I will always speak out against distorting Marriage in our Nation. That is part of a good moral Nation.

    The institution of marriage was created by man you fool! Our Constitution says “all men are created equal.” If a man and woman can marry, so should two people of the same sex if they choose.

    I’m married to a woman but it’s none of my business what gays decide to do with their lives-my wife agrees with me on this because like me, she’s very well educated and very well traveled in this world.

    Betty, I was watching Chris Rock on comedy central the other night and I have to say he totally hit the nail on the head when he was talking about gay marriage, he said that we don’t value the institution of marriage with shows like the Bachelor or any one of those “reality” shows so why is gay marriage a violation of such an institution? And as Alex said the divorce rate here is insane, so again this shows a lack of respect of the institution of marriage the way you argue it. Honestly, with so much misery in this world why not make a few more people happy and let them marry, by the sound of it this won’t have any effect on the world you choose to live in.

    DH-It’s refreshing to hear a republican stand up for civil liberties like gay marriage. Thank you! I know there are lot’s out there but I just don’t see many of you on TV!

    And that’s what I was saying in my other post about the distorted labels we have in this country. What the hell does liberal and conservative mean in this country anymore?? In my opinion these labels mean nothing!

    Many republicans would view your comments as liberal, but historically you are a true conservative-smaller government, government staying out of peoples lives, etc.

    Bellie-Yeah, the institution of marriage in this country is an ABSOLUTE joke considering the divorce rate is over 50%. So since our closets are fucked we better go ahead and dictate how other people lead their lives!

    Mr. DH, I am very proud of my and my Dad’s stand against gay marriage. I don’t see how anyone can equate family values with gay marriage. It is indeed unnatural and just a bad idea for our nation. I am very grateful that our Governor here in California also has taken a stand against it too. And don’t forget Mr. DH, most Americans feel the same way I and others do.

    I am very proud of my Dad too, he is great father and a good American.

    Hi bellie, I understand that the institution of marriage in our nation has it’s share of problems, and there are far too many single family homes. Every child has a right to a Mom and Dad, and there are many good, solid marriages in this nation. So why toss another threat and distraction to the state of marriage with something as outrageous as gay marriage?
    If two people of the same gender wish to live together, fine, just leave Marriage out of it.

    Betty no offense, but did I mention single parent homes… NO! I grew up in a single parent home, want to know why… my father passed away when I was 12, so don’t judge single parent homes as you have no idea why they are like that. Perhaps, like me it wasn’t a choice and for others it is really better the parents not live together, but hey who am I to judge the reason. As I said people in this world are rather unhappy, if you make some people happy by letting them marry than I think it makes the world a little better place. No one gave you the right to judge others. It doesn’t worry me what you do with your life so stop worrying what others do with theirs and enjoy the short time you have on a beautiful and amazing world despite all the messed up stuff.

    I’m convinced the first thing that needs to happen concerning gay marriage is to come to the understanding that marriage is a religious ceremony.

    If this is agreed upon then of course it naturally follows that in a country that claims a seperation of church and state that marriage regardless of the gender of the people involved should not be recognized by the government in the first place.

    This makes all “marriage” in effect civil unions. Now who can object to 2 people legally binding themselves to each other in a partnership?

    My question is: How fast would the opposition change if the word marriage was to be legally challenged on the basis that it violates the seperation of church and state? After all isn’t the argument of the opposition to “gay marriage” based on religious beliefs. I hear the bible quoted a lot in reference to this issue.

    Since when does a majority of people constitute what is right or wrong? A majority of Germans once believed Hitler was right, the minority as it turns out were right. Most of that minority that spoke out were imprisoned or killed.

    The majority of the world hates Americans. Using your logic then they must be right.
    The majority of Americans and the majority of the world think we are wrong for being in Iraq (myself included). Then since the majority agrees with me what are we doing over their Betty?

    Good morning DH. In response to your comments about Walter Reed Hospital, I have never volunteered there. However I have spoken with Veterans who have recently been through there and they tell me it is a state of the art institution and has improved a lot. The VA Hospital I do volunteer at here is very clean, efficient and very considerate and respectful of the Veterans that come through there, including my Dad who is 50% disabled from service connected problems.

    On the other subject I am amazed at how easily those with liberal views (and supporting gay marriage is indeed a liberal view) I am amazed at how quickly you equate any stand a large majority of Conservatives take to the Nazis. It really shows how simple-minded I believe you are Mr. DH, which is also evidenced by your constant need to use foul language and vulgarities.

    My male friend in Iraq is merely a pen-pal now although we have shared pictures of each other. He understands my stand on any relationship, and he (being military) also understands he must pass muster with my father if he wishes to take me out.

    Good morning bellie, first of all, I understand there are circumstances that lead to single-family homes that cannot be helped, and I hope i did not offend you, perhaps I should have clarified it better. I am speaking about women who have children out of wedlock (by their own choice) or women who sleep around and wind up with a child or children. I believe every child deserves a mother and a father. Unfortunately there are circumstances that cannot be prevented, as yours was. But women who carelessly sleep around and bring children into a single-family home, that is what I was reffering to.

    My mother left my Dad when I was very young, being married to a Marine is not easy. So, my Dad and my Grandmother (when Dad was deployed or overseas) raised me. So I hope I cleared up what I meant about single-family homes.

    Walter Reed Hospital was a National disgrace which resulted in the resignation or relief of a Major General running Walter Reed; The Secretary of the Army and the Army Surgeon General DUE TO THE DEPLORABLE CONDITIONS. THIS WAS LESS THAN A YEAR AGO!

    I don’t even know where to start here but I can’t believe the banner advertisement on here just came up with some poll site with “Is Aids a gay disease?” Hmm, Betty, what do you think?

    By the way Betty, things don’t add up with you. You said in a previous comment that your parents were still together. And you also said in another one that you needed to go cook for your man.

    Jeff, DH and Bellie, all excellent comments and thank you for making this conversation so interesting.

    Yeah, I think we need to throw the conservative and liberal labels in this country out the window. The parties are using it to pit people against each other-the difference between Betty’s “conservative” view on the world and DH’s “conservative” view on the world are night and day.

    There’s so much going on in this conversation so I might as well give my background too. I’m a registered democrat to vote in primaries but I used to consider myself independent. But the last few years (because of the polarizing nature of the president) I find that I view myself more and more as a democrat.

    But as a “liberal” I don’t believe in irresponsible gov’t wasting tax money and middle class peoples taxes ballooning and a bigger bureacracy in this country than there already is. I worked on an MBA at the University of Central Florida, I didn’t finish that but I have a business background too.

    At the most basic level, we need government and we need taxes to build roads and schools.

    But seeing as how we have money to blow on wasteful wars like Iraq, I think that money is better suited to be pumped into education and healthcare (in some form).

    We have the biggest prison population in the world: over 2 million people! We WASTE money trying people and convicted them because they have some pot on them. Thanks beer and drug companies!!

    I think marijuana should be decriminalized-fine people who have small amounts on them and use that money for social programs or whatever. Instead, we waste money on them.

    I also think states other than Nevada could legalize prostitution and benefit as per tax purposes, rather than keeping it criminalized and again, wasting tax money to incarcerate people. Shit, I wrote about that in a high school paper! Got an “A” on it too :)

    So my thoughts are “extremely liberal” but economically speaking, there are conservative elements in what I am saying.

    Good evening Alex I was saying those things when I first got her, that you mentioned, because I do not trust internet blogs, etc and I did not want to reveal too much about myself. But some of the comments on here have been so inane and vulgar and silly that I felt the need to be more upfront about myself and my situation.

    I am proud of my Dad and Grandmother who did really raise me after Mom left and I am proud of waiting for marriage before I give myself to a man.

    I am also proud of being a conservative Republican.

    However I see no further need to respond to “DH” because he is vulgar and seems to take everything too personally. He is very immature for a father and husband.

    By the way, Bellie is my wife and I know she doesn’t like me talking about this but when I lived with her in Australia she voted for John Howard who is a member of their “liberal party” but is an economic conservative, while he is also a social conservative he didn’t try and lay down his religious values on the Australian people. But like Tony Blair in the UK, his downfall was brown nosing Bush too much and now he’s gone.

    When my wife first moved to the US she was shocked at how much religion is involved in our politics. We are supposed to have a separation of church and state but we don’t.

    It’s good if you believe in God, have good values, etc. but if someone isn’t harming someone else, why shouldn’t they be happy?

    I’ll be honest here, I used to oppose gay marriage simply because I disagreed with the lifestyle (I was raised by my Dad with intolerance towards gays). A lot of what we believe is how we were raised, but it’s important that we evolve if there is some flaw in the logic.

    I’m 29 now and it was only a couple years ago that I changed my views on this. I mean seriously, what business is it of mine??

    By the way DH, a Hillary win will make me sick too, I’m tired of this two family crap.

    Even if the state of California did get gay marriage banned who would that be helping? Who does that make happy? What is the benefit?
